It is best practice to record all agreements or affidavits deciding who shall serve as the next trustee.
Law
A.R.S. § 14-107.04 specifies when a vacancy occurs in the trusteeship. It makes it clear that a vacancy in a co-trustee position does not have to be filled. It allows the qualified beneficiaries to fill a vacancy in the trusteeship by unanimous agreement.
